What happened

Class period: May 28, 2023 through May 31, 2023

- In May 2023, cybercriminals exploited a vulnerability in MOVEit Transfer, a file transfer tool used by hundreds of companies including Cadence Bank, and helped themselves to personally identifying information (PII) they had no business touching

- The breach window was narrow (May 28 to May 31, 2023) but the fallout was wide: names, Social Security numbers, financial account details, and other sensitive data were potentially exposed

- Cadence began notifying affected customers around September 15, 2023

- A class action lawsuit followed, alleging Cadence failed to adequately protect customer data

- Cadence denies wrongdoing but agreed to a $5,250,000 settlement rather than let the case drag on, and eligible class members can now file a claim

Extra details

- You must choose between reimbursement of losses OR the $100 cash payment. You cannot stack both, but you can combine either option with the free credit monitoring

- If total claims exceed the net settlement fund, the $100 payment will be reduced pro rata. If claims fall short, it could increase up to $1,000

- You cannot both opt out and object. Pick one lane. If you submit both, the objection gets voided and you are treated as having opted out

- Do not contact the Court, the Clerk's office, or Cadence Bank directly about your claim

FAQ

Do I need to prove I was actually harmed to file?
Nope. The $100 alternative cash payment and free credit monitoring require no documentation at all, just a completed claim form submitted by June 4, 2026.
How much will I actually get?
For the cash payment option, the base amount is $100. It can go up to $1,000 if not many people file, or down if the fund gets overwhelmed. Documented loss claims pay out the actual amount you can prove, up to $2,500 for ordinary losses or $10,000 for extraordinary losses.
What if I want to sue Cadence Bank on my own instead?
You will need to opt out by May 5, 2026. If you file a claim or do nothing, you give up the right to sue Cadence separately for these claims. Choose wisely.
Can I get credit monitoring AND cash?
Yes. You can combine credit monitoring with either the cash payment or a loss reimbursement claim. The only thing you cannot do is claim both reimbursement and the cash payment at the same time.
Is this related to other MOVEit breach settlements I have heard about?
Yes and no. The MOVEit vulnerability affected hundreds of companies. This specific settlement only covers individuals notified by Cadence Bank. If your data was exposed through a different company that used MOVEit, this claim will not cover you. Check for a separate settlement from that company.
